Fans have supported the decision of Nintendo to take down Heaven Studio Github as they violated the bylaws by using Nintendo’s original assets, both art and sound effects, and were hanging by a hair’s thread as it is. Heaven Studio knew the path they were venturing on was not one full of roses and honey.

Nintendo‘s legal team has been on the prowl lately, issuing takedowns against musicians and sheet music found guilty of using the company’s original assets. There is a very fine way around making a fan game that is covered under the parody law that states you can make a fan game as long as you do not use the company’s assets, you don’t charge money, and you don’t make an existing game.

Heaven Studios failed to adhere to these laws, which resulted in the DMCA taking down their software. They are charged with using the company’s original assets, which makes them vulnerable to the aftereffects. The Heaven Studio Github page has been officially taken down, but that doesn’t seem to be the end of it.

Heaven Studio shared their thoughts on the matter on social media, putting forth their point that it is not the end for the studio and they will surely come out of this stronger by changing certain key elements of their software, but that it is going to take some time before they can make a public appearance again with the new features they have to offer.

Sharing their thoughts on the matter via X, they said:

It is clear from their statement that the studio is ready to surrender to the situation while thinking about the future, take some time to rectify their mistakes and come out stronger.

Nintendo was not wrong in taking action against them, which also made Heaven Studio think of its capabilities beyond recreating Rhythm Heaven, and maybe their next venture would turn out to be a lot better than the former.
